The agreement
These terms are an agreement between you and Avocet. By using the app, you agree to them. If you do not agree, do not use the app.
How we handle your data is covered separately in the privacy policy.
Who can use Avocet
You must be at least 13 years old. If you use the app on behalf of a company, you confirm you have the authority to agree to these terms for it.
Your account
You can use the app without an account. If you create one, keep your password to yourself and tell us if you think someone else has used it. You are responsible for what happens under your account.
What you write
Your notes are yours. We claim no ownership of anything you type, say, or upload. To run the service we need your permission to process that content: to store a note you share, to send speech to be transcribed, and to send text to a language model when you ask for cleanup, Ask, or writing checks. You give us that permission for those purposes only, and it ends when you delete the content.
You are responsible for the content you create and share. Do not use the app to store or share material you do not have the right to, or that is unlawful, harassing, or harmful to others.
Plans and payment
Free gives you 3 notes of up to 500 words each, on this device, at no cost.
Pro removes those limits and adds dictation, cleanup, and Ask. It costs $15 a month billed monthly, or $108 a year billed once. Prices are in US dollars and exclude any tax your country adds at checkout.
Payments are taken by Polar, our payment provider. Your plan renews automatically until you cancel. Cancel any time from Billing in the app; you keep Pro until the end of the period you have paid for, and you are not charged again. We do not refund partial periods, except where the law requires it.
If we change a price, we will tell you at least 30 days before it applies to you. The change takes effect at your next renewal after that.
Dictation and AI features
Dictation, cleanup, Ask, inline AI, and writing checks use speech and language models. They make mistakes. Cleanup shows every change it made so you can put your wording back, and Ask offers edits for you to apply rather than applying them for you. Check what they produce before you rely on it.
Dictation clips are limited in length, and we may limit how much you can dictate or ask in a period to keep the service fair for everyone. Any limit will be shown in the app.
Acceptable use
Do not:
- break the law, or help someone else to
- send abuse, threats, or spam through shared notes or invites
- try to access other people’s notes or accounts
- probe, overload, or interfere with the service or its providers
- resell the service or use it to build a competing one
Availability and changes
We work to keep Avocet available, but we do not promise it will never be down. Your notes live on your device, so an outage does not take them away. We may change or remove features. If we remove something you paid for, we will tell you and give you a way to export your notes first.
Ending the agreement
You can stop using the app at any time. To close an account, email support@tryavocet.com. We can suspend or close an account that breaks these terms, or that is used to harm the service or other people. Where we can, we will tell you why.
What we do not promise
The app is provided as it is. We do not promise it is free of errors or fit for a particular purpose. To the extent the law allows, we are not liable for indirect losses, or for losses above the amount you paid us in the twelve months before the claim. Nothing here limits rights the law gives you as a consumer.
Changes to these terms
We may update these terms. The date at the top shows the current version. For a change that affects your rights, we will tell you in the app or by email before it takes effect. Using the app after that means you accept the new terms.
